Gitlow is called a bad guy by the Government. They say that Gitlow is trying to overthrow the government by force because of what he wrote.

Here I am! You cannot charge Gitlow under the Criminal Anarchy Law because it is unconstitutional.

It is unconstitutional because states can not create laws that break the First Amendment protections under the Due Process Clause of the 14th Amendment. AKA, you are not giving him a right to freedom of speech.


Also, the states need to prove that Gitlow's writing was a clear danger, but Gitlow's writing did not create any danger and it has not been proven otherwise. There is no need to get rid of his free speech.
